A patent is a statutory right for an invention granted to patentee for a limited period of time from the govt. Patentee gives full details of his invention in the application to Registrar.
Patent means Invention and Invention means new product or process involving inventive step and capable of industrial application.
Inventive step means features of invention that involves technical advance as compared to the existing knowledge or having economic significance or both that makes the invention net obvious to a person skilled in the art.
Person entitled to make application for patent:
(a) By any person claiming to be true and first inventor of the invention.
(b) By any person being the assignee of the person claiming to be true and first inventor in respect of the right to make such an application.
(c)By the legal representative of any deceased person who immediately before his death was entitled to make such application. Application may be made by one of persons either alone or jointly with any other person.
Patent protection is territorial right and therefore it is effective only within the territory in India. However filing a application in India enable to be file other application for same invention in other countries within or before expiry of 12 months from the filing date in India. Therefore separate patent may be obtained in each country where the applicant requires protection of his invention in those countries. There is no patent valid worldwide.
